Will Scalia Eat His Words?

According to CNN, Scalia said he was saddened to see the Supreme Court deciding moral issues not addressed in the Constitution, such as abortion, gay rights and the death penalty. He said such questions should be settled by Congress or state legislatures beholden to the people.

SO DOES THIS MEAN THAT WHEN THE BIBLE THUMPERS' ATTORNEYS APPEAL AN ABORTION ISSUE TO THE SUPREME COURT THAT SCALIA WILL DECIDE NOT TO GRANT THE BIBLE THUMPERS AN APPEAL?

I'll be watching.

I have a question for you banana - a legal question:

The Plame scandal covers one instance of the Administration's pattern of intelligence doctoring and misuse to justify war.

Does Fitzgerald's mandate legally allow him to go bigger than the Plame case and blow all of this wide open (lies told to Congress to justify war, etc) or is he resigned to just the Plame incident?

oh my. i'm not an expert on the law, just a student, but this is my guess:

Fitzgerald probably already has more informaton than what we know about Downing Street and the Niger incident and all the other parts of the conpsiracy of the Bush Admin to commit war crimes (why Bush didn't agree to sign America onto the World Court, I'm sure);

how much of this information that Fitzgerald has gathered will be made public record depends on how far they're going to have to take and use circumstantial evidence to show or get an inference of the requisite intent of the suspects who leaked Plame's name.

I have no idea really. What will be interesting is the information that they get out on that memo that was passed around all of Bush's close aides and staffers regarding Valerie Plame. Remember that one? the one that was passed around before Novak's article was written?

That will be the clincher.

But if they get into having to use testimony I'm sure that the CIA will be spilling out all kinds of information that will show just how we Americans were lied to back in 2002 and 2003 by Bush, Cheney, Rumsfeld, Rice, and Powell.

But I really don't have any idea, this is just my guess.

Of course the attorneys of the suspects (Cheney, Libby, Rove, etc) will do their darndest to make sure that as little of this stuff gets into evidence as possible.

I'm sure these suspects' attorneys have already researched the law and have already got their motions in limine prepared.

we're supposed to find out what's up, who the suspects are, in September aren't we?

I know Fitzgerald is supposed to wrap up by October.

It's a good guess. It makes sense - the only way then, that he can go after them for the big stuff is during the process of proving their motivation for outing Plame.

I'M GUESSING. however, once the trial starts, anything that is admitted into evidence, not under seal, becomes public record.

that includes transcripts, documents, everything. all you have to do is go to the court where the trial is going on and ask to see the record. it helps if you have the docket number...of course we have to wait until it gets out of the grand jury, wait until there is an indictment, before we can do this. i think grand jury stuff remains secret.
